Introduction
By voluntarily submitting this form and authorizing the quarterly contribution (“Community Development Charge”) to Amicorp Community Foundation South Africa NPC (“ACF SA,” “the Foundation,” “we,” “our,” or “us”), you (“Donor”) agree to be legally bound by the following Terms and Conditions. These govern your contributions and your relationship with the Foundation.
- Entity Status
- ACF SA is a non-profit company registered in South Africa (Registration No. 2025/264319/08) under the Companies Act, 2008.
- The Foundation is in the process of applying for Public Benefit Organisation (“PBO”) status with the South African Revenue Service (“SARS”) but has not yet been granted PBO status. Until formal approval is received, the Foundation cannot issue Section 18A tax-deductible receipts.
- Purpose of Contribution
- Contributions support the Foundation’s mission to advance education, skills development, and social upliftment in South Africa, primarily through funding and oversight of vocational training initiatives such as the Limpopo Vocational Center (LVC).
- All contributions will be applied solely to public-benefit activities in accordance with the Foundation’s Memorandum of Incorporation and applicable laws.
- Quarterly Contribution and Invoicing
- Your chosen contribution amount will be added as a “Community Development Charge” to your Amicorp invoice on a quarterly basis.
- By submitting this form, you authorize Amicorp to process the contribution with each invoice cycle.
- Contributions are voluntary and non-refundable.
- Use of Funds
- All contributions will be applied exclusively toward the Foundation’s public-benefit activities, including but not limited to:
- Funding vocational education and skills development programs;
- Oversight and governance of implementing partners;
- Administration, reporting, and monitoring;
- Community outreach and engagement initiatives.
- No part of your contribution will be used for private benefit, profit, or personal gain by any director, employee, or related person of the Foundation.
- No PBO Status Yet / Tax Implications
- Since the Foundation has not yet obtained PBO status from SARS, donations cannot currently be claimed as tax-deductible under Section 18A.
- Should PBO status be granted in the future, tax-compliant receipts will be issued in accordance with SARS regulations and applicable tax law.
- Donors are responsible for determining the tax treatment of their contributions in their respective jurisdictions.
- Amendment and Cancellation
- Donors may amend or cancel their quarterly contribution by providing written notice to Amicorp.
- Changes will take effect from the next invoicing period following receipt of your request.
- The Foundation and Amicorp reserve the right to update these Terms and Conditions as required, with notifications provided to donors.
- Data Protection and Privacy
- The Foundation collects and processes personal data in accordance with applicable data protection laws and its Privacy Policy.
- Personal information will be used solely for processing contributions and related communications.
- Governance, Oversight, and Compliance
- Contributions may be disbursed to implementing partners (e.g., LVC Pty Ltd) under written grant agreements specifying approved use, reporting, and independent audit verification.
- The Foundation maintains appropriate accounting systems, policies, and internal controls to ensure funds are applied exclusively to public-benefit activities.
- All activities will comply with South African law, including the Companies Act, Income Tax Act, and other applicable regulations.
- Limitation of Liability
- To the fullest extent permitted by law, neither the Foundation nor Amicorp shall be liable for any direct, indirect, incidental, consequential, or punitive damages arising from contributions or use of the Foundation’s services.
- The Foundation does not guarantee any tax benefit or financial return to donors.
- Dispute Resolution
- Any disputes arising from your contribution or these Terms and Conditions shall be governed by South African law and subject to the exclusive jurisdiction of South African
courts.
- Acknowledgment and Acceptance
- By checking the box below and submitting this form, you confirm that you:
- Have read, understood, and accepted these Terms and Conditions in full;
- Acknowledge the current status of the Foundation’s PBO application;
- Voluntarily agree to make the quarterly contribution as selected; and
Agree that contributions are applied solely to public-benefit activities in line with the Foundation’s mission.
